Terms of service
These Terms and Conditions apply to all orders placed with StoryTiles. If you would like a printed copy of these Terms and Conditions, we will be happy to send one to you. The current Terms and Conditions have been filed with the Chamber of Commerce in Amsterdam. The most recent version is always valid, or, in special cases, the version that was valid at the time of the order. These Terms and Conditions apply to both consumer and non-consumer purchases.
Article 1. Identity of the StoryTiles
StoryTiles, KNSM-laan 101, 1019LB, Amsterdam, email address: hello@storytiles.com
Account number: 7750440 in the name of StoryTiles in Amsterdam
(IBAN: NL58INGB0007750440 and BIC: INGBNL2A) VAT No.: NL862484583B01 and Chamber of Commerce No.: 82473919.
Article 2. Acceptance of the Terms and Conditions
These General Terms and Conditions apply to any offer and agreement between StoryTiles and a second party (the customer), unless the parties have expressly waived these General Terms and Conditions in writing.
These Terms and Conditions also apply to agreements with StoryTiles to the extent that StoryTiles engages third parties to perform the work.
Any deviations from the current Terms and Conditions will be valid only to the extent that they have been expressly agreed upon in writing in advance.
Article 3. Order Confirmation
All offers are non-binding and must be made in writing, in any form. Each offer must be dated and is therefore traceable by date.
StoryTiles is bound by offers only if the customer accepts them, preferably in writing, within 30 days. All prices include sales tax.
As soon as StoryTiles' bank confirms the payment, StoryTiles will accept and fulfill the order.
StoryTiles cannot be held to its offers if the customer, based on the principles of reasonableness and fairness and in accordance with generally accepted social norms, could have known that the offer or a part thereof contained an obvious error or a typographical error.
If (on minor points) the acceptance differs from the offer set forth in the proposal, StoryTiles is not bound by it. In that case, the agreement is not formed in accordance with this differing acceptance, unless StoryTiles indicates otherwise.
StoryTiles may—within the limits of the law—verify whether the customer is able to meet their payment obligations, as well as all facts and factors relevant to the responsible conclusion of the distance contract. If, based on this investigation, StoryTiles has good grounds not to enter into the agreement, it is entitled to refuse an order or request, stating its reasons, or to impose special conditions on its fulfillment.
Article 4. Right of Withdrawal
When purchasing products, the customer has the right to cancel the contract within 14 days without providing a reason. This cooling-off period begins on the day after the customer, or a representative designated in advance by the customer and notified to StoryTiles, receives the product.
During the cooling-off period, the customer will handle the product and its packaging with care. The customer will unpack or use the product only to the extent necessary to determine whether the customer wishes to keep it.
If the customer exercises their right of withdrawal, the customer must return the product to StoryTiles along with all accessories provided and—if reasonably possible—in its original condition and packaging, in accordance with the reasonable and clear instructions provided by StoryTiles, within 14 days of receiving return instructions from StoryTiles.
If the customer exercises their right of withdrawal, they will be responsible for no more than the cost of return shipping.
If the customer has made a payment, StoryTiles will refund that amount as soon as possible, but no later than 14 days after the return or cancellation.
Exclusion of the right of withdrawal is only possible for products: a. that were created by StoryTiles in accordance with the customer’s specifications; b. that are clearly of a personal nature; c. that, by their nature, cannot be returned.
Article 5. Prices
The total amount shown in the shopping cart, quote, or invoice is final and includes the prices of the ordered products, processing fees, packaging materials, and shipping.
All prices and shipping costs for consumer sales are listed in euros, including VAT. Different VAT provisions may apply to non-consumer sales.
StoryTiles will send a separate invoice to an address specified by the customer only upon the customer’s express request.
There is no VAT refund.
Article 6. Delivery
StoryTiles will do everything possible to have the items delivered to the address clearly specified by the customer as soon as the order is accepted and payment has been confirmed.
The ordered items will be delivered by a third party. For orders outside the EU, the customer is responsible for any import duties in his or her country.
All delivery-related costs are the responsibility of the customer. If you are not present at the time of the scheduled delivery of the plain tiles, you will be charged an additional fee for a new delivery appointment.
Shipping costs within Europe are subject to the VAT rate in effect at that time, as determined by the Dutch government.
If the customer refuses to accept the goods or fails to provide instructions or information regarding their delivery, any additional costs incurred for redelivery or storage of these goods will be borne by the customer.
Any delivery date mentioned by StoryTiles is subject to change. Depending on the country, delivery times may vary from four (4) to (30) business days.
Article 7. Warranty
StoryTiles guarantees that the ordered items will meet the usual standards of quality and expectations, and that it will do everything in its power to ensure that these items are handled with the utmost care so that they conform to the description provided on the website at the time the order was placed.
No warranty will be provided for goods where it is clear that a) their inoperability was caused by improper or incorrect use, b) the customer or third parties have made or attempted to make modifications to the goods without StoryTiles’ knowledge or written consent, c) if the items have been used for purposes for which they were not intended.
StoryTiles accepts no liability whatsoever for the mounting system. StoryTiles also accepts no liability for any other ways the product may be used or installed.
Article 8. Receipt
As soon as the ordered goods have been delivered—or, in any event, as soon as possible—the customer must verify that everything is correct. The customer must verify that both the quality and quantity of the delivered goods are in accordance with what was agreed upon, or at least meet the standards that apply in the normal course of business.
Any visible defects and/or deficiencies must be reported to StoryTiles by email within 48 hours, with a clear description of the issue and the number on the packing slip.
If the customer wishes to return the aforementioned items, the customer must contact StoryTiles. These items may be returned only—and at the customer’s own expense—if StoryTiles has given its written consent.
The right of withdrawal may be excluded only for items: a. that were created by StoryTiles in accordance with the customer’s specifications; b. that are clearly personal in nature; c. that, by their nature, cannot be returned.
Article 9. Transfer of Risk
The risk of loss or damage to the products that are the subject of the agreement passes to the customer at the time they are delivered to the customer and thereby brought into the possession of the customer or a third party designated by the customer.
Article 10. Payment
Payment to StoryTiles must be made prior to delivery, unless otherwise agreed.
Orders will be processed and shipped once the bank has confirmed payment.
The following information will be requested: name, address, ZIP code, phone number, email address, payment information, and shipping address if it differs from the address provided earlier.
After that, an email will be sent to you automatically containing a number to confirm your order.
In accordance with the Personal Data Registration Act, no information will be disclosed to third parties, with the exception of parties involved in fulfilling the order.
Article 11. Right of Retention and Retention of Title
In the event of non-payment or late payment, StoryTiles reserves the right of retention. StoryTiles retains title to the goods until payment for the delivered goods has been made.
Article 12. The Right to Terminate the Agreement
The customer has the right to cancel the purchase within 14 days without providing a reason. This must be communicated to StoryTiles in writing. All costs incurred in returning the items are the customer’s responsibility.
Article 13. Copyrights
StoryTiles reserves all rights and powers to which it is entitled with respect to the provisions regarding intellectual property.
The design of the online store, photos, drawings, sketches, videos, software, and all other materials—including (electronic) files—remain the property of StoryTiles. This also applies to materials provided to the customer or third parties, unless otherwise agreed in writing.
If the customer uses the items mentioned above, they may be used solely by the customer, and they may not be reproduced, made public, or disclosed to third parties without StoryTiles’ prior written consent.
Article 14. Liability
If goods delivered by StoryTiles are not in proper condition, StoryTiles’ liability to the customer is limited to the provisions set forth in the terms and conditions under “Warranty.”
If the manufacturer of the delivered goods is liable for consequential damages, StoryTiles’ liability is limited to replacing the item(s) in question or refunding the purchase price.
The customer is personally responsible for his or her choice of products. StoryTiles is not liable if any damage incurred is due to willful misconduct, negligence, and/or culpable conduct, or to improper or inappropriate use by the customer.
StoryTiles shall not be liable for any incorrect or delayed processing of order information or communications to the Customer resulting from the use of the Internet or any other means of communication in the exchange between the Customer and StoryTiles, nor for any damages that may arise therefrom.
Article 15. Force Majeure
. Neither StoryTiles nor the customer is obligated to fulfill any obligation if they are prevented from doing so as a result of circumstances beyond their control, and for which neither is liable under the law, a legal act, or generally accepted principles.
For the purposes of these general terms and conditions, “force majeure” means, in addition to what is understood by that term in law and case law, all external causes—whether foreseeable or unforeseeable—over which StoryTiles has no control, but which prevent StoryTiles from fulfilling its obligations.
StoryTiles also reserves the right to invoke force majeure should circumstances such as those described above arise after StoryTiles was required to fulfill its obligations.
If, in the event of force majeure, StoryTiles is able to deliver a different item, the customer may return the item and expect a replacement. Shipping costs are the responsibility of the buyer.
Article 16. Indemnification
The customer shall indemnify StoryTiles against any third-party claims relating to intellectual property rights in materials or data provided by the customer that are used in the fulfillment of the order.
The customer shall also guarantee that any data storage media, electronic files, software, etc., provided to StoryTiles are free of viruses and defects.
Article 17. Complaints
Complaints must be submitted to StoryTiles at KNSM-laan 101, 1019LB, Amsterdam.
Article 18. Disputes
The Amsterdam District Court has exclusive jurisdiction to hear disputes.
Article 19. Governing Law
Dutch law applies to all agreements between StoryTiles and its customers.
In the event of translations, the original Dutch text of these terms and conditions shall prevail.
